The Portage SR application is developed by the Centre d’accueil le Programme de Portage inc., Le Programme de Portage relatif à la dépendance de la drogue inc. (collectively called Portage).

 

TERMS AND CONDITIONS

These Terms and Conditions govern the use and free subscription to the Portage SR application.

The purpose of these Terms and Conditions is to provide a legal framework for the terms and conditions under which Portage makes the site and services available and to define the conditions of access and use by the user.

Before accessing the application, we ask you to read these Terms and Conditions because they constitute a legal contract between you and Portage.

BY ACCESSING OUR APPLICATION, YOU CONFIRM THAT:

YOU HAVE READ AND AGREED TO THE TERMS AND CONDITIONS, YOU WILL ABIDE BY THEM, YOU ARE OF LEGAL AGE AND COMPETENT TO ENTER INTO A LEGAL CONTRACT AND/OR YOU HAVE RECEIVED AUTHORIZATION FROM A COMPETENT PERSON TO DO SO ON YOUR BEHALF.

We reserve the right to change the Terms and Conditions at any time. Any changes will be effective immediately upon posting.

Your use of our services constitutes acceptance of these Terms and Conditions.

CAUTION: THIS IS NOT A MEDICAL AND/OR CLINICAL APPLICATION

The application is for informational purposes only, for private use, limited to a single installation key. Users who have already completed the Portage program will be able to access it only to share their thoughts in preparation for their social reintegration.

Any involvement of a third party such as, without limiting the generality of the foregoing, Android or Apple is not related to us in any way and we disclaim any responsibility for their actions, omissions, products, services.

Just like a notebook, the content of the application is personal and is not created to be shared. Thus, no tracking whatsoever is done in this regard and we do not respond to any questions you may ask through the application, by email or any other mean of communication. Please be aware that the application is not a tool for communication with staff members. Portage is not responsible for the content submitted by the user, the consequences, actions, and acts, omissions directly or indirectly related to the content submitted by the user. We do not guarantee, replace, substitute or claim to provide any treatment, cure, therapy, medication, diagnosis or medical recommendation.

At all times, please consult a health care professional immediately if your health condition requires it. IN CASE OF EMERGENCY, PLEASE CALL 911.

 

Account and Registration:

By creating an account, you are responsible for protecting the security of that account and any activities or actions taken in connection with it. Therefore, you have an obligation to notify us of any breach of the account. We are not responsible for any acts or omissions by you or for damages related to such acts or omissions.

 

Account Content:

You are the sole owner of the content you post to the Portage application in the course of using our services. You are solely responsible for the integrity, reliability, appropriateness, intellectual property and/or right to use the content submitted.

 

No use prohibited by applicable law will be tolerated.

In order to provide the service to you, you give us permission to access, copy, store, reformat, transform the Submitted Content. At all times, please be aware that we take all necessary measures to protect your privacy and the confidentiality of your information, but we reserve the right to delete, remove or terminate any account if required to do so by law.

 

Intellectual Property

Portage owns the canva of the application as well as the property rights.

Unless otherwise specified, the rights apply to all documents, data, compilations and other works that are published on the site. The trademarks and logos used or displayed on the application are trademarks registered or not by Portage. It is prohibited to use a trademark or logo reproduced on the portal without the prior written authorization of its owner.

The display, downloading, and reproduction of elements (text and images) of the Portage application are authorized on the condition that they are carried out for non-commercial purposes, that the elements of the portal are not modified, and that the user retains all intellectual property notices contained therein during any of these operations.

 

Limitation of liability

Neither Portage nor any of its representatives, agents, directors or employees, nor any other person associated with the creation of this application, shall be liable for any damages or losses (whether in contract, tort, negligence or otherwise) that may arise in connection with the content, use or inability to use this site, or for any failure, error, omission, interruption, defect, delay in operation or transmission, computer virus, line failure or system failure, loss of data or otherwise, including, without limitation, direct, indirect, special, consequential, exemplary or punitive damages, losses or expenses.

This privacy policy informs you about the information Portage collects and how it is used. It also informs you of the security measures that are in place to protect your information and your privacy when using the application.

In this context, changes to this privacy policy may occur at any time. We will notify you of any changes by updating the "Last Updated" date on this Privacy Policy. We encourage you to review this Privacy Policy from time to time to stay informed of any updates.

Please note that this Privacy Policy does not replace the privacy policy of the platform from which you install the Application and is complementary to it.

This Privacy Policy contains the information required by applicable law as well as additional information that will allow you to make a free and informed choice regarding the use of our application.

 

General Limitations

Portage limits the collection, use and disclosure of your personal information to the purposes identified in this Privacy Policy.

Your personal information may only be accessed by authorized individuals and only in the context of their assigned duties.

In certain limited circumstances, Portage may collect, use or disclose personal information without your knowledge or consent. Such circumstances arise when, for legal, medical or security reasons, it is impossible or unlikely to obtain your consent or when the information is required for the enforcement of applicable laws.

 

Purposes of Collection and Authorized Persons

If you use the application, Portage will conclude that you implicitly consent to the use of the personal information contained therein to enable the operation of the application.

Collection of information in the application

The information you provide in the application remains your property and is saved on Portage's servers. Some information may be stored momentarily in your smartphone but is not shared with third parties.

 

Retention of information

Portage retains your personal information for as long as necessary for the purposes for which it was collected. Portage destroys this personal information in accordance with applicable laws. When Portage destroys your personal information, it takes the necessary measures to ensure its confidentiality and to ensure that no unauthorized person can access it during the destruction process.

 

Your personal and confidential information is retained, directly or through subcontractors, only for as long as necessary to fulfill the purpose for which it was collected and the applicable legal and regulatory requirements. In all cases, access to your personal and confidential information is restricted to those individuals for whom access is required in the performance of their duties.

Portage has implemented several security measures with respect to the personal and confidential information you provide to us, in order to protect it against loss, theft and to prevent unauthorized access, transmission, use or modification.

 

Right of access

You may, upon request and after reasonable notice, subject to any regulatory or contractual restrictions, request the removal of, access to, or correction of your personal information held by Portage. Portage will ensure that such information is provided to you within a reasonable period of time from the date of receipt of the written request unless the right of access is denied for legal or security reasons.

Any such request must be forwarded to the person responsible for access to information.
